Terms of service
By booking a workshop, commissioning artwork, purchasing a Paint Party Kit, or hiring Muse&Flow for any creative service, you agree to the following terms. These terms are governed by the laws of the State of Florida.
Muse&Flow is operated by Patricia Machin as a sole proprietor based in Miami, Florida.
Bookings & Payments
A 50% non-refundable deposit is required to secure your date or begin a commission. The remaining balance is due before the event or before final delivery, unless otherwise agreed in writing.
Custom requests, expedited timelines, or out-of-scope additions may require additional time and charges, quoted in advance.
Accepted payment methods will be provided at the time of invoicing.
Cancellations & Rescheduling
Cancellations made 7+ days before the event: full refund minus the non-refundable deposit and any processing fees.
Cancellations made within 7 days: 50% refund or credit toward a future service.
Cancellations within 48 hours are non-refundable.
Rescheduling is allowed once at no additional cost, provided notice is given at least 7 days before the original date. Additional reschedules may incur a fee.
Force Majeure
If an event cannot take place due to circumstances beyond reasonable control — including but not limited to severe weather, hurricanes, natural disasters, illness, government orders, or venue closures — Muse&Flow will work with the client to reschedule at no penalty. Deposits remain valid and transferable to the new date.
Event Responsibility & Liability
Muse&Flow provides all materials needed for the booked experience unless otherwise stated.
The client is responsible for providing safe working conditions and adequate space for workshops and live art services.
Muse&Flow will take reasonable care to protect surfaces and surroundings but is not responsible for accidental stains, spills, or damage caused by participants during any creative activity.
Participants acknowledge that creative activities involve materials such as paints, adhesives, scissors, and other supplies that may stain clothing, cause skin irritation, or pose minor risks. Participation is voluntary and at each participant's own risk.
Muse&Flow is not liable for personal injury, allergic reactions, damage to personal belongings, or any indirect or consequential damages arising from participation in a workshop or event.
Clients and participants are responsible for disclosing relevant allergies or sensitivities in advance. Muse&Flow is not liable for reactions to undisclosed sensitivities.
Minors
Participants under 18 must be accompanied and supervised by a parent or legal guardian unless prior arrangements have been made in writing. The supervising adult is responsible for the minor's safety and conduct throughout the event.
Client & Participant Conduct
Muse&Flow reserves the right to refuse service, pause, or end an event without refund if any participant behaves in a way that is unsafe, disrespectful, or disruptive to the experience or to other participants.
Travel
Events within Miami-Dade County are included in standard pricing. Events outside Miami-Dade may incur a travel fee, quoted in advance based on distance and time.
Commissions
Commissioned artwork (including portraits, illustrations, and design work) is subject to these additional terms:
A 50% non-refundable deposit is required to begin the work. The remaining balance is due before final delivery.
Estimated timelines are provided at the start of the project and may shift based on complexity, revisions, or material availability.
Each commission includes up to two rounds of revisions at no additional cost. Additional revisions are billed at an hourly rate quoted in advance.
Reference materials, photos, or detailed direction provided by the client must be supplied at the start of the project to avoid delays.
Final approval is required before the piece is finalized and shipped or delivered.
Once a commission is approved as complete, all sales are final.
Muse&Flow retains the right to photograph and display the finished work in its portfolio, on social media, and on its website for promotional purposes, unless the client requests otherwise in writing before the project begins.
The client receives the physical artwork and personal-use rights. Commercial reproduction, resale, or use of the artwork for branding, merchandise, or commercial purposes requires a separate written licensing agreement.
Intellectual Property
Participants own the physical artwork they create during a Muse&Flow workshop.
All Muse&Flow curriculum, instructional materials, methods, branding, written content, photography, and proprietary creative formats remain the property of Muse&Flow and may not be reproduced, recorded, taught, or distributed without written permission.
Photo & Media Release
By attending a Muse&Flow workshop or event, participants consent to being photographed or filmed and to the use of those images and videos by Muse&Flow for promotional purposes — including social media, website content, marketing materials, and portfolio use. If a participant prefers not to be photographed, they may notify Muse&Flow in writing before the event and reasonable efforts will be made to honor the request.
